PRIVACY AND COOKIE POLICY

INTRODUCTION

At Hamamatsu Photonics A/S, Bregnerødvej 144, 3460 Birkerød, Denmark, CVR no. 10048265 (“we”, “us”), we take the protection of personal data seriously. This Privacy and Cookie Policy (“Policy”) explains how we process personal data when you visit our website, interact with us on social media, subscribe to our newsletter, or communicate with us as a representative of a customer, vendor, or other business partner. We process personal data in accordance with applicable data protection law, including the EU General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”) and the Danish rules on storage of and access to information on terminal equipment (the Danish “cookie rules”) implementing Article 5(3) of the ePrivacy Directive.

Hamamatsu Photonics A/S is the data controller for the processing of your personal data described in this Policy, unless otherwise stated (e.g., where we and a social media provider are joint controllers). Below we describe our main processing activities, including purposes, categories of personal data, recipients, retention, and the legal bases for processing.

If you have questions about this Policy or wish to exercise your data subject rights under Chapter III of the GDPR, please contact us at dataprivacy@nktphotonics.com. If your request relates to cookies/consent choices, you can also use the cookie settings tool available on the website.

CATEGORIES OF PERSONAL DATA, PURPOSE, AND LEGAL BASIS

Website visitors and newsletter recipients

When you visit Hamamatsu Photonics A/S’ website: www.lf.hamamatsu.com (“Website”), Hamamatsu Photonics A/S will process personal data about you, for instance, cookies and your IP address. The purpose of using cookies is, i.a., to improve your user experience on Hamamatsu Photonics A/S’ website, to provide functionality, to generate statistics, to target the marketing of our products to your needs, and to remember your preferences.

The legal basis for processing personal data collected through cookies and similar technologies depends on the type of cookie/technology. Strictly necessary cookies (including cookies that are necessary to provide a service explicitly requested by you) are processed on the basis that they are necessary for the Website to function and/or for us to provide the service you request (GDPR Art. 6(1)(f) and/or Art. 6(1)(b), as applicable) and are exempt from the consent requirement under the Danish cookie rules. All other cookies and similar technologies (e.g., preferences, statistics/analytics, and marketing) are used only with your prior consent (GDPR Art. 6(1)(a) and the Danish cookie rules).

When we rely on your consent (e.g., for statistics/analytics or marketing cookies), you may withdraw your consent at any time by changing your cookie settings on the Website. Withdrawal of consent does not affect the lawfulness of processing based on consent before it was withdrawn.

If you subscribe to our newsletter, we process your name (if provided), your email address, and your preferences/areas of interest (if provided) to send you newsletters and tailor the content. The legal basis is your consent (GDPR Art. 6(1)(a)). You can withdraw your consent at any time by using the unsubscribe link in the newsletter or by contacting us. Sending marketing by email may also be subject to applicable marketing rules.

Contact persons at a customer, vendor, or another business partner

As a contact person at a customer, vendor, or another business partner, Hamamatsu Photonics A/S processes your personal data when you communicate with Hamamatsu Photonics A/S, e.g., via emails in connection with Hamamatsu Photonics A/S’ existing contractual relationship with the company you are employed with or in connection with the conclusion or termination of a contract. Hamamatsu Photonics A/S processes ordinary personal data about you, including your name, email address, telephone number, position, etc.

The legal basis for such processing of your personal data is that the processing is necessary for the purposes of legitimate interests pursued by Hamamatsu Photonics A/S and that it is Hamamatsu Photonics A/S’ assessment that our legitimate interests override your interests or fundamental rights and freedoms, cf. Art. 6(1)(f) of the GDPR. Hamamatsu Photonics A/S’ legitimate interests are fulfilment of our contractual obligations, maintaining and enhancing customer relationships, invoicing for the services your company provides to Hamamatsu Photonics A/S and/or vice versa, communicating with you if you have any questions related to our services or vice versa, and for documentation purposes in the event you agree on matters relating to our services in writing via email.

In some cases, the processing of personal data is necessary to comply with a legal obligation to which Hamamatsu Photonics A/S is subject, for instance, in relation to the obligation on the preservation of accounting records pursuant to the Danish Bookkeeping Act. In such cases, the legal basis for the processing is Art. 6(1)(c) of the GDPR.

RECIPIENTS OF YOUR PERSONAL DATA

Where relevant, Hamamatsu Photonics A/S may disclose or transfer your personal data to affiliates of Hamamatsu Photonics A/S, business partners, or other collaborators for business purposes. Such third parties also include social media providers, as described in.

In certain specific cases, e.g., in connection with disputes, including when the disclosure of your personal data is necessary for the establishment, exercise, or defense of Hamamatsu Photonics A/S’ legal claims, Hamamatsu Photonics A/S may disclose your personal data to its advisers or other relevant third parties, provided it is deemed necessary and lawful.

Certain recipients process personal data on behalf of Hamamatsu Photonics A/S and may only process your personal data in accordance with documented instructions given by Hamamatsu Photonics A/S and further terms and conditions stated in a data processor agreement entered into with Hamamatsu Photonics A/S. These data processors are not permitted to process your personal data for their own purposes.

ADDITIONAL INFORMATION REQUIRED UNDER GDPR

Sources of personal data: We primarily collect personal data directly from you (e.g., when you contact us or subscribe to our newsletter) and automatically from your device/browser when you use the Website (e.g., via cookies and similar technologies, subject to your choices). In a B2B context, we may also receive contact details from your employer or from publicly available sources (e.g., company websites and professional networking platforms).

If you choose not to provide certain information (e.g., not subscribing to the newsletter or not providing details needed to respond to your inquiry), we may not be able to send the newsletter or respond/perform a contract. Where we rely on consent (e.g., for optional cookies or newsletters), you can refuse or withdraw consent without adverse consequences beyond the relevant functionality not being available.

TRANSFER OF YOUR PERSONAL DATA TO A THIRD COUNTRY (OUTSIDE OF EU/EEA)

In certain cases, your personal data may be transferred to countries outside of the EU/EEA. Hamamatsu Photonics A/S ensures that such transfer will be carried out in accordance with the applicable data protection laws. Hamamatsu Photonics A/S will ensure the implementation of supplementary safeguards if deemed necessary in the specific case. If relevant, you may receive a copy of the legal basis for transfers upon request. Please contact dataprivacy[AT]lf.hamamatsu.com.

Personal data collected via cookies and similar technologies is stored for different periods depending on the cookie/technology. Details (including retention periods) are provided in the cookie declaration available through the cookie settings tool on the Website.

Personal data processed in relation to our social media presence is generally retained in accordance with the settings and retention practices of the relevant social media platform and our own retention needs (e.g., to handle your inquiry, moderation, and documentation). Content is typically deleted when you delete it or when we delete it in accordance with our retention practices.

If you are a contact person at a customer, vendor, or another business partner, Hamamatsu Photonics A/S will store personal data about you as long as Hamamatsu Photonics A/S communicates with you because you are Hamamatsu Photonics A/S’ point of contact, 3 years after termination of the contractual relationship, or such longer period of time which is necessary for the establishment, exercise, or defense of a legal claim.

Hamamatsu Photonics A/S will store your personal data to the extent it is necessary for bookkeeping purposes, such as personal data related to invoicing. Such personal data will be stored for a period of 5 years from the end of the financial year to which the accounting records relate. The purpose is to comply with the legal obligation pursuant to the Danish Bookkeeping Act and other applicable legislation.

What are cookies?

A cookie is a text file that is sent to your browser from our website and saved on your computer, phone, or whichever device you use to access the internet. However, the meaning of the word “cookies” in this Privacy Policy and the consent text also includes other kinds of automated data collection, e.g., Flash-cookies (Local Shared Objects), Web Storage (HTML5), JavaScript, or cookies placed by the use of other kinds of software. The word “cookies” also refers to information about MAC addresses and other information about your device.

There are two types of cookies – so-called session cookies and persistent cookies. Session cookies are information units that are deleted when you close your web browser. Persistent cookies are information units that are stored on your computer until they are deleted. Persistent cookies delete themselves after a certain period but are renewed each time you visit the Website. Hamamatsu Photonics A/S uses both session cookies and persistent cookies. Read more about this below, where you will also find an overview of the specific cookies used by the Website.

The purpose of cookies

Cookies may be used for several purposes, but in essence, they are used to save information about your activity on the internet. Cookies contain information that later can be read by a web server on the domain that issued the cookie in question. This means that the relevant website remembers you the next time you visit it.

We collect information via cookies to improve your user experience of our website and products, to provide and improve usability and functionality, to generate statistics, analysis, and website performance reviews, to remember your preferences, for marketing purposes, tracking of your location, and to customize our advertising on social media platforms. The benefit for you is that you will save time next time you visit the Website, as you do not have to enter the same information again, and that the content will be adjusted to your preferences

How long are cookies stored?

Cookies delete themselves after varying periods but are updated automatically when you visit the Website again.

Information about your online behavior, including cookies accepted by you, will be deleted in different intervals as described in the cookie declaration below.

Third-party cookies

To further develop and improve the Website, we use cookies from certain third parties. The purposes are the preparation of statistics and the analysis of online behavior. The third parties place the cookies on your computer on our behalf and prepare the statistics, etc. Third parties used are listed in the cookie declaration below.

What cookies are used for on the Website?

We use cookies and similar technologies to help the Website function, to remember choices you make (where you consent), to understand how the Website is used (where you consent), and to support marketing activities (where you consent). Depending on the cookies/technologies used, information may be shared with third-party providers (e.g., analytics, advertising, and social media providers).

Please see the cookie declaration in the cookie settings tool for details of specific cookies/technologies, providers, purposes, and retention periods.

Cookie Declaration will be available soon

Please note that if you opt out, there are features and services on our Website that you cannot use because they require the Website to remember the choices you make.

Cookies that you have previously accepted can easily be deleted subsequently. If you use a computer with a newer browser, you can delete your cookies using the shortcut keys: CTRL + SHIFT + Delete. If the shortcut keys do not work and/or if you use a MAC, you must start by finding out which browser you are using, and then click on the relevant link with guidelines on how to opt out of cookies:

Note that if you use multiple internet browsers, you must delete cookies in all your browsers.

Our use of so-called “social media plugins” on our website provides us with information about the number of visitors on the Website in response to social media advertisements.

When you visit our social media sites on e.g., Facebook, or LinkedIn, or our website where social media plugins have been installed, our social media service providers collect and process your personal data using cookies, subject to your consent to the service provider, as applicable. Such collection and processing take place even if you have no account on social media.

When you visit our Facebook and/or LinkedIn site, Hamamatsu Photonics A/S receives anonymous demographic and geographic statistics from Facebook and LinkedIn on the visitors to our Website and our Facebook or LinkedIn site. It happens via Facebook’s and LinkedIn’s plugins (“Facebook Pixel” and “LinkedIn Insight Tag”).

Hamamatsu Photonics A/S may be a joint controller with the relevant social media provider for certain processing activities (for example, insights/statistics about visitors to our pages). In such cases, the allocation of responsibilities between us and the provider is governed by the provider’s joint controller arrangements (where available). The social media provider typically has primary responsibility for processing on the platform (including enabling data subject rights). You can still contact us to exercise your rights in relation to processing we control.
